Valice Law Pty Ltd ABN 76 665 176 616 trading as Valice™ (Valice, we, us and when relating to us, our) is an Australian law firm. This document sets out the way in which Valice, and any of its related entities, collect, hold, use and disclose personal information (Privacy Policy).
Valice is committed to protecting the privacy of our contacts, customers, suppliers and employees (you and when relating to you, your) and complying with the Australian Privacy Principles set out in the Privacy Act 1988 (Cth) (Privacy Act).
By using our website or services, or otherwise providing us with your personal information, you consent to us collecting, holding, using and disclosing your personal information in accordance with this Privacy Policy.
1 Collection, storage and use of personal information
1.1 What personal information we may collect
In this policy, personal information has the meaning given in the Privacy Act – that is, information or an opinion (whether true or not) about an identified individual or an individual that is reasonably identifiable.
We collect both personal and non-personal information. The type of personal information we collect depends on the nature of your dealings with us, but may include the following:
- general, personal and business details such as your name, occupation, role or position, date of birth, contact information (including address, email address, phone numbers), payment details, employment history, education and qualifications, business skills and other information that may be relevant to our business or the services we provide;
- information about a person’s circumstances, affairs, legal interests and requirements relevant to the matter(s) in which we are instructed;
- information regarding a person’s attendance at seminars and promotional events held by us;
- in respect of a supplier or prospective supplier, information about their business skills, services, products and prices; and
- in respect of a company or other business, information about its personnel or business associates.
We may collect non-personal information provided to us by your browser when you visit our website or access any of our applications.
1.2 How we collect personal information
- Where practicable, we collect personal information about you directly from you. However, we may also collect information about you from a third party.
- We collect personal information by various means, including:
- from you directly, when you provide us with your information;
- from you indirectly, through emails, meetings, online inquiries, telephone conversations, attendance at seminars or events hosted or attended by us, subscription to our newsletter or legal updates service, or through visiting our website; and
- from third parties, including our clients when they provide information relating to related and/or adverse parties relevant to the services we are providing; third party information providers; the courts; a person responding to our questions or inquiries; professional reports relevant to a service we are providing; employment references, and other third parties that may provide information relevant to our business or the service we are providing.
1.3 Why do we collect, hold, use and disclose personal information?
- It is our policy to only collect, hold, use or disclose personal information for the purposes for which it was collected. This includes to:
- provide or market our services and undertake our business;
- communicate with you in relation to our services;
- employ suitable personnel;
- to comply with our legal obligations;
- monitor or improve the use of, and satisfaction with, our services (including our website); and
- let you know about legal developments, our expertise and legal services that may be of interest to you.
- If you are a client and do not provide us with the personal information we require, we cannot act for you.
- If the personal information you provide us is inaccurate or misleading in any respect, we may not be able to carry out our instructions or achieve the purpose for which the information has been sought.
2 Disclosure of personal information
2.1 Who your personal information is disclosed to
- Subject to our confidentiality obligations, we may disclose some relevant personal information with:
- parties related to a matter you have with us, government authorities and service providers as reasonably required to carry out your instructions;
- our clients, where your personal information was collected in connection with a matter they have with us;
- legal consultants and specialists (including barristers) when using their services in support of our legal practice;
- our e-mail marketing provider for the purposes of providing you our newsletter, invitations and legal updates; and
- third party service providers who assist us with archival, auditing, accounting, legal, business consulting, website or technology services; and
- to suppliers, contractors and agents engaged by us from time to time.
- We will also disclose your information if required by law to do so or in circumstances permitted by the Privacy Act – for example, where we have reasonable grounds to suspect that unlawful activity or misconduct of a serious nature, that relates to our functions or activities, has been, is being, or may be, engaged in; or in response to a subpoena, discovery request or a court order.
2.2 Disclosure outside of the jurisdiction of collection
We aim to use services that are located, and store their data, in Australia, however some of the third parties described above may be located (or store their data) outside of Australia, including in the United States of America, India or the Asia-Pacific region.
3 Security
- Valice takes reasonable steps to protect your personal information from misuse, interference, loss, unauthorised access, modification and disclosure through implementing and maintaining various physical, technical and administrative safeguards (including the secure storage and, where relevant, destruction of any printed materials containing personal information; password protected IT systems with up to date anti-virus software that are regularly checked and audited; employees of Valice must respect the confidentiality of personal information held by Valice as a condition of employment). However, we cannot guarantee the security of your personal information as the internet is not a secure platform.
- Our website and electronic communications may contain links to third party websites. Valice is not responsible for the privacy practices, policies or content of those such websites.
4 General
4.1 Opting out of marketing communications
We may, from time to time, send you newsletters, invitations and legal updates about our services. You can opt out of receiving further such communications by notifying us using our contact details set out below, or by clicking the “unsubscribe” option at the foot of any marketing email received from us.
4.2 Access, correction or updating personal information
- You can contact us to access, correct or update your personal information by contacting our Privacy Officer (using the details in the “contact us” section below).
- Following a request for access, unless we are subject to confidentiality obligations or are permitted to refuse you access under the Privacy Act, we will endeavour to make your information available to you within 30 days. Examples of circumstances where we may refuse to give you access to your personal information include where:
- giving access would be unlawful;
- we reasonably believe that giving you access would pose a serious threat to the life, health or safety of any individual or to public health or public safety;
- giving access would have an unreasonable impact on the privacy of others;
- the information could reveal the intentions of a party in negotiations;
- giving access could prejudice the taking of appropriate action in relation to unlawful activity; or
- giving access could reveal evaluative information in a commercially sensitive decision making process.
- We will not charge you to make a request to access your record, but we may charge you to actually provide access depending on the costs associated with obtaining and providing the material.

4.4 Making a complaint
If a breach of this policy occurs, or you have any questions about the handling of your personal information, you may contact our Privacy Officer (using the details in the “contact us” section below).
We will endeavour to respond to any complaint within 30 days. If you are not satisfied with our response to your complaint, you may seek a review by contacting the Office of the Australian Information Commissioner using the information available at http://www.oaic.gov.au/privacy/privacy-complaints.
